What are Maine's overtime rules in 2026?
Maine follows the federal 40-hour weekly overtime rule: non-exempt employees earn 1.5 times their regular rate for all hours over 40 per workweek (Maine Title 26 §664). Maine does not have a daily overtime threshold. However, Maine independently sets its own salary-exemption threshold at $871.16 per week ($45,300.32 per year) as of January 1, 2026 — salaried workers earning at or below this level cannot be classified as overtime-exempt, regardless of their job duties.
When must Maine employers issue a final paycheck?
Maine employers must pay all final wages no later than the employee's next established payday, and that payday must be no more than two weeks after the last day of work (Maine Title 26 §626).
